just a month ago a judge in virginia declined to throw out a lawsuit filed by that state, making similar claims that the obama health care plan requirement is unconstitutional. the judge wasn't clear about which parts. it's more than he wuntd clear. he just declined to say which parts of the case he would throw out. this case in florida makes two claims. the constitutional claim, and then they also say that the state should not have to pay additional medicaid costs. that it's unconstitutional to require them to come up with the money for the program. he didn't say which parts he'll throw out. the fact that he'll let the case continue is another tactical victory for critics of the plan. >> thank you very much, pete williams. again, that ruling from the judge is expected october 14th. thank you, pete. >>> and right now hurricane igor is pushing across the atlantic on a track that could take it directly to bermuda. igor is expected to remain a dangerous category 4 hurricane through thursday before it reaches the bahamas this weekend. then forecasters believe it will downgrade it to a cat 2.
